Terms of Service
Thought Architecture — operated by TK Publications (ABN 76 792 942 026)
Last updated: 29 July 2026
1. About these Terms
These Terms of Service (Terms) govern your use of the Thought Architecture coaching application and the website at thoughtarchitecture.com.au (together, the Service). The Service is operated by TK Publications, a partnership registered in Queensland, Australia (ABN 76 792 942 026), trading as Thought Architecture (we, us, our).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you confirm that you are 18 or older and that the information you provide is accurate.
3. What the Service is
Thought Architecture is an AI-assisted thinking coach built on the A.I.S.I.R. method: Awareness, Intent, Structure, Iteration and Reflection. It is designed to help you examine and structure your own thinking before and alongside your use of AI.
The Service does not provide legal, financial, medical, psychological or other professional advice and is not a substitute for advice from a qualified professional. It is not a counselling, mental-health, crisis or emergency service. If you are in distress or experiencing an emergency, contact the appropriate emergency service or crisis-support service in your location.
You remain responsible for your decisions, actions and use of any response, score, Thought Blueprint or optimised prompt generated through the Service.
4. Your account
Your account is personal to you. You must not share it or allow another person to use it. You are responsible for keeping your login details secure and for activity undertaken through your account. Please contact us promptly if you believe your account has been accessed without permission.
You must provide current and accurate account and billing information.
5. Fair use
Each account may start up to 50 new coaching sessions in each calendar month, calculated using Australia/Brisbane time. Sessions already started may still be continued after the monthly limit is reached. The allowance resets automatically at the beginning of the next calendar month.
This limit protects the availability and affordability of the Service and helps prevent account sharing and automated or excessive use. You must not attempt to avoid the limit by creating or sharing accounts or by interfering with the Service's controls.
6. Subscription, free trial and billing
The Service is available on either:
- a monthly subscription of AUD $19.50 per month; or
- an annual subscription of AUD $149 per year.
Prices are in Australian dollars. We are not currently registered for GST, so GST is not added to these prices.
Eligible new subscribers receive one seven-day free trial on the monthly or annual plan selected at checkout. A valid payment method is collected when the trial starts. Except where you confirm a plan change that causes an immediate charge, no subscription fee is charged during the trial.
Unless you cancel before the trial ends, Stripe charges the selected plan when the trial ends. If no valid payment method is held at that time, the subscription is cancelled rather than converted to a paid subscription.
Returning subscribers who have already used a trial are charged for the selected plan when they restart. Creating a replacement account does not guarantee eligibility for another trial.
Your subscription renews automatically at the end of each monthly or annual billing period until you cancel. By subscribing, you authorise us, through Stripe, to charge your nominated payment method for the initial paid period and each renewal.
We will give reasonable advance notice of a price change. A changed price will apply from a subsequent renewal as described in that notice.
7. Changing plans and failed payments
You may be able to change between monthly and annual billing through Stripe's customer portal. Stripe displays the effective date and any amount payable or credited before you confirm a change.
Changing plans during a free trial may end the trial immediately and result in an immediate charge for the new plan. Review Stripe's confirmation screen carefully before approving a change. If you need help while trialling the Service, contact us before changing plans.
If a renewal payment fails, Stripe may retry the payment during its configured recovery period. While a subscription is marked past due, you may retain access to the Service and will see a request to update your payment details. If payment is recovered before the subscription is cancelled, the subscription returns to normal. If recovery attempts are exhausted, the subscription is cancelled and access to coaching ends.
Paying an invoice after its connected subscription has already been cancelled settles that invoice but does not reactivate the cancelled subscription. You must start a new paid subscription to regain access, and a further free trial will not be available if you have already used one.
8. Cancellation and refunds
You may cancel through the customer portal available in your account settings.
If you cancel during a free trial, access ordinarily continues until the scheduled end of the trial and no first subscription charge is made. If you cancel a paid subscription, access ordinarily continues until the end of the current paid period and the subscription does not renew.
Cancelling does not ordinarily create a refund for an unused part of a monthly or annual billing period. Annual subscriptions are paid in advance; cancelling part-way through a paid year stops the next renewal but does not ordinarily create a refund for the remainder of that year.
Our Refund Policy explains how refund and billing enquiries are handled.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Where the Australian Consumer Law gives you a remedy, that remedy applies despite any other part of these Terms or the Refund Policy.
9. Acceptable use
You must not:
- use the Service for an unlawful, fraudulent, harmful or abusive purpose;
- enter sensitive or identifiable information about another person unless you have a proper basis to do so;
- attempt to interfere with, disrupt, overload or gain unauthorised access to the Service or its systems;
- attempt to circumvent subscription, usage, safety or security controls;
- use automated means to scrape, probe or operate the Service without our written permission;
- share, resell, sublicense or commercially exploit access to the Service without our written permission; or
- use the Service in a way that infringes another person's rights.
We may restrict, suspend or terminate access where we reasonably believe these Terms have been breached, where necessary to protect the Service or another person, or where required by law.
10. Your content and intellectual property
You retain your rights in the information you enter into the Service (Your Content). You give us a limited licence to host, store, transmit and process Your Content only as reasonably necessary to provide, secure, maintain and support the Service and to comply with law. Our handling of Your Content is described in the Privacy Policy.
As between you and us, you may use the Thought Blueprints and optimised prompts generated for your account. AI-generated material may not be unique, and the same or similar material may be generated for another person. These Terms do not guarantee that an AI-generated output is protected by intellectual-property law or suitable for a particular use.
The Thought Architecture name, branding, software, user interface, coaching system and associated materials, and the A.I.S.I.R. method and materials, are owned by us or our licensors and are protected by applicable intellectual-property laws. Except for the rights expressly granted in these Terms, no rights in those materials are transferred to you.
You are responsible for ensuring that you have the right to submit Your Content, including any information about another person.
11. AI-generated responses
The Service uses artificial intelligence to generate coaching responses, Thought Readiness Scores, summaries, Thought Blueprints and optimised prompts. AI-generated material may be incomplete, inaccurate or unsuitable for your circumstances.
The Service is intended to support—not replace—your judgement. You are responsible for reviewing and verifying outputs and for deciding whether and how to use them.
12. Availability, changes and account closure
We aim to keep the Service available and reliable, but do not guarantee uninterrupted or error-free access. Maintenance, provider outages, capacity limits, security events or circumstances beyond our reasonable control may temporarily affect availability.
We may update or change features where reasonably necessary to maintain, secure or improve the Service. If we discontinue the paid Service, we will take reasonable steps to notify affected subscribers and provide any remedy required by law.
You may stop using the Service and delete your account at any time through Settings. Account deletion is permanent and is described in the Privacy Policy.
13. Liability
Nothing in these Terms excludes, restricts or modifies liability, a consumer guarantee, or a right or remedy that cannot lawfully be excluded, restricted or modified.
To the maximum extent permitted by law:
- the Service is provided on an as-available basis;
- we do not guarantee that AI-generated material is accurate, complete or fit for a particular purpose; and
- we are not responsible for loss caused by your reliance on an output without applying your own judgement or obtaining appropriate professional advice.
Any other limitation of our liability applies only to the extent it is fair, reasonable and legally permitted in the circumstances.
14. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain and protect personal information and forms part of these Terms.
15. Changes to these Terms
We may update these Terms where reasonably necessary, including because the Service, our providers or applicable laws change. We will publish the updated Terms and their effective date. Where a change is material, we will take reasonable steps to notify you and may require you to accept the updated Terms before starting another coaching session.
16. Governing law
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
